			<content:encoded><![CDATA[<p>Going by the historical background of the original Constitution and the backgrounds of each amendment is the only objective standard to interpret the Constitution. </p>
<p>With a &#8220;<a href="http://www.frugallivingguide.com/tag/living/" rel="tag" >living</a>&#8221; Constitution there is no rule of law, instead it becomes a &#8220;fad&#8221;. We may as well live in England where there is no Constitution and the law is whatever the government says it is. How about this? What if the President declared a national emergency and at the same time, he declares martial law and has all the Congressional leaders killed and elections banned. How about this?  The ruling party who has control of all three branches decides to ban elections due to national emergency. Then what? How does a &#8220;<a href="http://www.frugallivingguide.com/tag/living/" rel="tag" >living</a>&#8221; Constitution not lead to a dictatorship?</p>
<p>Bonus question: Why waste all that time in a law library when it is really easy to read a simple document such as the Constitution and use some common sense such as knowing that the founding fathers would never have stood for an 11 trillion dollar debt, worlds policemen, drug wars, and things such as the Patriot Act?<br />
Bash, he was advocating the amendment process and it still doesn&#8217;t mean we shouldn&#8217;t go by the orgininal intent of each new amendment.<br />
Jackie, I was giving you hypothetical scenario&#8217;s. You know what the term hypothetical means?</p>
<p>As far as slavery is concerned, it is clearly meant to ban the slave trade when the 13th amendment was written and the 19th amendment clearly does not make women property.</p>
<p>Juries in the last 1,000 years have ruled on the morals of laws as well as facts and it is unlikely that any jury would find you guilty simply for being a woman. They would find that as immoral and this was the original intent of the founders for jury duty.<br />
Divot,  Our rights are allowed to adapt but the governments powers cannot because the Constitution only refers to what the government can and cannot do.<br />
An amendment would need to be passed to regulate internet speech.<br />
I&#8217;ll give an example. The banning of alcohol was passed with an amendment. Some might argue that it would be hard to pass amendments for every single act but this is the founding fathers entire point when it comes to limiting government.</p>
